WHEREAS,
 
the
 
State
 
of
 
New
 
Mexico
 
has
 
a
 
constitutional
 
obligation
 
to
 
provide
 
all
 
students,
 
particularly
 
those
 
who
 
are
 
economically
 
disadvantaged,
 
Native
 
American,
 
English
 
language
 
learners,
 
and
 
students
 
with
 
disabilities,
 
with
 
sufficient
 
educational
 
opportunities,
 
as
 
affirmed
 
by
 
the
 
landmark
 
Martinez/Yazzie
 
decision,
 
which
 
found
 
that
 
the
 
State
 
has
 
historically
 
underfunded
 
public
 
schools;
 
and
 
WHEREAS,
 
adequate
 
and
 
consistent
 
funding
 
is
 
critical
 
to
 
ensuring
 
that
 
all
 
students
 
have
 
access
 
to
 
high-quality
 
teachers,
 
instructional
 
materials,
 
safe
 
facilities,
 
technology,
 
and
 
other
 
resources
 
necessary
 
for
 
success;
 
and
 
WHEREAS,
 
inflationary
 
pressures
 
and
 
increases
 
in
 
the
 
cost
 
of
 
goods
 
and
 
services,
 
including
 
salaries,
 
health
 
insurance,
 
transportation,
 
facilities
 
maintenance,
 
instructional
 
resources,
 
technology,
 
and
 
school
 
safety
 
enhancements,
 
erode
 
the
 
real
 
value
 
of
 
educational
 
funding
 
each
 
year;
 
and
 
WHEREAS,
 
inconsistent
 
or
 
inadequate
 
funding,
 
especially
 
during
 
economic
 
downturns,
 
exacerbates
 
inequities
 
between
 
low-poverty
 
and
 
high-poverty
 
school
 
districts
 
and
 
has
 
long-term
 
negative
 
effects
 
on
 
student
 
outcomes,
 
making
 
stable
 
funding
 
mechanisms
 
essential
 
to
 
protect
 
against
 
future
 
disinvestment;
 
and
 
WHEREAS,
 
predictable,
 
inflation-adjusted
 
increases
 
in
 
the
 
State
 
Equalization
 
Guarantee
 
(SEG)
 
would
 
provide
 
school
 
districts
 
with
 
the
 
ability
 
to
 
responsibly
 
plan
 
budgets,
 
sustain
 
academic
 
programs,
 
and
 
ensure
 
equitable
 
access
 
to
 
opportunities,
 
and
 
the
 
Consumer
 
Price
 
Index
 
(CPI)
 
provides
 
a
 
reliable
 
measure
 
of
 
inflation
 
that
 
reflects
 
changes
 
in
 
the
 
cost
 
of
 
living
 
that
 
must
 
be
 
accounted
 
for
 
in
 
state
 
funding
 
decisions;
 
and
 
WHEREAS,
 
modern
 
school
 
operations
 
require
 
ongoing,
 
reliable
 
investments
 
in
 
digital
 
technology
 
and
 
school
 
safety,
 
yet
 
New
 
Mexico
 
public
 
schools
 
have
 
historically
 
had
 
to
 
rely
 
on
 
unpredictable,
 
one-time
 
legislative
 
appropriations
 
(such
 
as
 
the
 
$35
 
million
 
distributed
 
via
 
House
 
Bill
 
450)
 
or
 
capital
 
outlay
 
packages
 
rather
 
than
 
stable,
 
recurring
 
operational
 
line
 
items
 
embedded
 
directly
 
within
 
the
 
state
 
funding
 
formula;
 
and
 
WHEREAS,
 
modernizing
 
the
 
State
 
Equalization
 
Guarantee
 
(SEG)
 
to
 
include
 
a
 
permanent,
 
dedicated,
 
and
 
recurring
 
categorical
 
funding
 
line
 
item
 
for
 
technology
 
and
 
safety
 
would
 
align
 
New
 
Mexico
 
with
 
successful
 
funding
 
models
 
used
 
in
 
other
 
states,
 
which
 
leverage
 
dedicated
 
state
 
aid
 
formulas
 
and
 
categorical
 
grants
 
to
 
ensure
 
consistent,
 
annualized
 
support
 
for
 
digital
 
integration
 
and
 
school
 
safety
 
infrastructure;
