WHEREAS,
 
the
 
State
 
of
 
New
 
Mexico
 
has
 
a
 
constitutional
 
obligation
 
to
 
provide
 
all
 
students,
 
particularly
 
those
 
who
 
are
 
economically
 
disadvantaged,
 
Native
 
American,
 
English
 
language
 
learners,
 
and
 
students
 
with
 
disabilities,
 
with
 
sufficient
 
educational
 
opportunities,
 
as
 
affirmed
 
by
 
the
 
landmark
 
Martinez/Yazzie
 
decision,
 
which
 
found
 
that
 
the
 
State
 
has
 
historically
 
underfunded
 
public
 
schools;
 
and
 
WHEREAS,
 
adequate
 
and
 
consistent
 
funding
 
is
 
critical
 
to
 
ensuring
 
that
 
all
 
students
 
have
 
access
 
to
 
high-quality
 
teachers,
 
instructional
 
materials,
 
safe
 
facilities,
 
technology,
 
and
 
other
 
resources
 
necessary
 
for
 
success;
 
and
 
WHEREAS,
 
modern
 
school
 
operations
 
require
 
ongoing,
 
reliable
 
investments
 
in
 
digital
 
technology
 
and
 
school
 
safety,
 
yet
 
New
 
Mexico
 
public
 
schools
 
have
 
historically
 
had
 
to
 
rely
 
on
 
unpredictable,
 
one-time
 
legislative
 
appropriations
 
(such
 
as
 
the
 
$35
 
million
 
distributed
 
via
 
House
 
Bill
 
450)
 
or
 
capital
 
outlay
 
packages
 
rather
 
than
 
stable,
 
recurring
 
operational
 
line
 
items
 
embedded
 
directly
 
within
 
the
 
state
 
funding
 
formula;
 
and
 
WHEREAS,
 
modernizing
 
the
 
State
 
Equalization
 
Guarantee
 
(SEG)
 
to
 
include
 
a
 
permanent,
 
dedicated,
 
and
 
recurring
 
categorical
 
funding
 
line
 
item
 
for
 
technology
 
and
 
safety
 
would
 
align
 
New
 
Mexico
 
with
 
successful
 
funding
 
models
 
used
 
in
 
other
 
states,
 
which
 
leverage
 
dedicated
 
state
 
aid
 
formulas
 
and
 
categorical
 
grants
 
to
 
ensure
 
consistent,
 
annualized
 
support
 
for
 
digital
 
integration
 
and
 
school
 
safety
 
infrastructure;

IT
 
RESOLVED

Schools
 
Board
 
of
 
Education
 
to
 
call
 
on
 
the
 
New
 
Mexico
 
State
 
Legislature
 
assembled
 
to
 
strengthen
 
and
 
modernize
 
the
 
State
 
Equalization
 
Guarantee
 
(SEG)
 
funding
 
formula
 
and
 
the
 
Public
 
School
 
Finance
 
Act
 
of
 
1974
 
by
 
enacting
 
the
 
following
 
legislative
 
mandate:
 
1.
 
Permanent
 
Recurring
 
Funding
 
Line
 
Item
 
for
 
Technology
 
and
 
Safety:
 
Establish
 
a
 
permanent,
 
dedicated,
 
and
 
recurring
 
categorical
 
funding
 
line
 
item
 
(categorical
 
aid)
 
within
 
the
 
SEG
 
formula
 
and
 
the
 
Public
 
School
 
Finance
 
Act.
 
This
 
line
 
item
 
shall
 
provide
 
stable,
 
annual
 
operational
 
funding
 
to
 
school
 
districts
 
specifically
 
earmarked
 
for
 
school
 
safety
 
measures
 
(including
 
physical
 
infrastructure,
 
secure
 
facilities,
 
and
 
security
 
personnel)
 
and
 
technology
 
integration
 
(including
 
student
 
devices,
 
network
 
infrastructure,
 
digital
 
resources,
 
and
 
cybersecurity).
 
This
 
recurring
 
formulaic
 
funding
 
will
 
replace
 
the
 
historical
 
reliance
 
on
 
inconsistent
 
one-time
 
legislative
 
appropriations,
 
allowing
 
school
 
districts
 
to
 
responsibly
 
plan
 
budgets
 
and
 
sustain
 
long-term
 
student
 
safety
 
and
 
technological
 
readiness.
